An insurer is not entitled to an offset when an automobile-accident victim receives Social Security disability benefits for injuries sustained in the accident, a Pennsylvania federal judge has ruled.

The U.S. District Court for the Western District of Pennsylvania denied Progressive Specialty Insurance Co.’s motion for partial summary judgment in a breach of contract and bad-faith case in which the company sought an offset under Section 1722 of the Motor Vehicle Financial Responsibility Law.
