This is my annual wish list for changes in law and legal practice for the coming year. I have included the suggestions of other members of the bar.
The Pennsylvania Supreme Court must clean up the Porngate mess. The court should appoint a special counsel, who will report directly to the Supreme Court, to assess how many judges were compromised by zealous prosecutors and determine how many cases were possibly affected. The court should take a hard look at the most troublesome problem that Porngate has exposed: the apparent routine ex parte communications between prosecutors and the judges they appear before. This practice is an insult to the citizens who pay taxes to support a fair and impartial judiciary, and professional prosecutors who are expected to be a separate branch of a government so that those suspected of a crime get a fair investigation and trial.
