Commonwealth v. Jones, PICS Case No. 16-0322 (C.P. Lawrence Dec. 16, 2015) Hodge, J. (16 pp.)
Defendant's Fifth Amendment rights were violated, because his furnishing of his identity while subject to investigative detention despite no reasonable belief of criminal activity gave police reason to arrest him, and the resultant evidence seized had to be suppressed; the false-identification charge failed, because he was not officially being investigated when he provided a false name. Defendant's pretrial omnibus motions granted, and charges dismissed.
