The Superior Court has reversed a trial court’s grant of summary judgment to two municipalities in a wrongful-death and survival action over a fatal accident between a motorcycle and a truck on an allegedly dangerous road in Allegheny County.
Material questions of fact exist regarding the municipalities’ actual or constructive notice of the dangerous condition, as well as the cause of the crash and whether it could have been prevented by a stop sign, President Judge Mary Hannah Leavitt wrote March 10 for a unanimous three-judge panel in Angell v. Dereno.
