The contentiousness that bounced a group of Paxil birth-defect cases between state and federal courts several years ago showed no sign of letting up as the first of those cases to hit trial got under way in state court Tuesday.
As opening statements were heard in Rader v. SmithKline Beecham, which is the first of nine cases pending in the Philadelphia mass tort program over claims that the antidepressant Paxil caused birth defects, numerous objections were made, and, about 20 minutes into the plaintiff’s statement, counsel for the defense moved for a mistrial.
