Philadelphia Gas Works’ practice of imposing liens against landlords for unpaid utility bills incurred by their tenants unconstitutionally violates those landlords’ due-process rights, a federal judge has ruled.

In a memorandum and order issued March 17, the Eastern District of Pennsylvania found that PGW’s methods don’t allow landlords the opportunity to address their tenants’ arrearages in a meaningful manner. The court said the city of Philadelphia should adopt a method similar to the one it follows in collecting overdue balances for water and sewer services in order to pass constitutional muster.
