Kohl’s and Capital One have successfully winnowed the claims against them in a putative class action alleging the companies charged excessive fees for add-on programs associated with the department store’s credit cards.
U.S. District Judge Wendy Beetlestone of the Eastern District of Pennsylvania found a number of the plaintiffs’ claims were either time-barred or pre-empted by a settlement in a similar suit against Chase Bank, which previously owned the Kohl’s credit card line.
