A Philadelphia judge has asked the state Superior Court to uphold his decision to toss a case claiming the weight-loss industry giant Nutrisystem stole trade secrets when developing a weight-loss ­smartphone application.

Philadelphia Court of Common Pleas Judge Ramy Djerassi issued an opinion last week in WebDiet v. Nutrisystem, urging the front-line appeals court to find that the Web developer-plaintiff failed to timely bring its breach of contract and misappropriation of trade secrets claims. Djerassi had tossed the claims on summary judgment in an opinion issued in late February.
