The plaintiffs in the Paxil birth-defect case that was tossed midtrial earlier this month have asked for a new trial, and a stay in the mass tort litigation.

The plaintiffs in Rader v. SmithKline Beecham filed a post-trial motion April 14, arguing that Philadelphia Court of Common Pleas Judge Kenneth Powell, who granted the defendant’s motion for nonsuit after two weeks of trial, misinterpreted a case management order, and should grant them a new trial.
