An effort by three Democratic state senators to prevent the General Assembly from delaying a public vote on the mandatory judicial retirement age in Pennsylvania has been rejected by the Commonwealth Court.

In a memorandum opinion in Costa v. Cortés issued Wednesday afternoon, Commonwealth Court Judge P. Kevin Brobson said that although pushing the ballot question from the April 26 primary election to the Nov. 8 general election will have “undesirable consequences,” the petitioners failed to demonstrate that any individual’s rights will be compromised by the delay. The lawsuit was filed last week by state Sens. Jay Costa, D-Allegheny, Daylin Leach, D-Montgomery, and Christine M. Tartaglione, D-Philadelphia, following the passage of House Resolution 783, which pushed back the vote.
