Attorneys for the Pennsylvania Office of Attorney General have filed a motion to dismiss a former agent’s whistleblower and First Amendment retaliation complaint against the office and several of its employees, including Chief of Staff Jonathan Duecker.

In a motion filed Monday, attorneys for the OAG argued that former agent Charles Horvath was not engaging in protected speech when he made the complaints to his superiors that he alleged resulted in his termination from the office. The OAG motion also said there is no plausible claim of causation between the more recent report, filed in 2013, and Horvath’s termination in 2015.
