The Montgomery County District Attorney’s Office has argued that Pennsylvania Attorney General Kathleen Kane’s appeal to the Pennsylvania Superior Court is premature and should not be allowed to proceed.
The office filed a motion to quash Kane’s appeal Monday, and it became publicly available Tuesday. According to the motion, signed by District Attorney Kevin Steele, Kane failed to cite any statute or rule in her notice of appeal that would justify an interlocutory appeal.
