A bankrupt debtor that has commenced a civil action can substitute its bankruptcy trustee as a plaintiff in that action, the Pennsylvania Supreme Court has ruled.
In a unanimous May 25 decision in Morrison Informatics v. Members 1st Federal Credit Union, the justices adopted a “relation-back approach,” allowing a bankruptcy trustee to maintain an action previously filed by a debtor.
