A municipal agency is not liable for damages caused by the involuntary motion of a government vehicle, the Commonwealth Court has ruled in an issue of first impression.

In a split June 3 decision in Balentine v. Chester Water Authority, the court found that the motor vehicle exception to governmental immunity under the Pennsylvania Political Subdivision Tort Claims Act did not apply to an accident in which an allegedly negligently parked Chester Water Authority truck was hit, pinning and killing Edwin Omar Medina-Flores.
