America’s oldest operating brewery needs to update its environmental approach. D.G. Yuengling & Son Inc. has agreed to nearly $10 million in penalties for allegedly discharging pollutants into a wastewater treatment plant in violation of the Clean Water Act, the Department of Justice and U.S. Environmental Protection Agency said Thursday.

According to a complaint filed in the Middle District of Pennsylvania, the brewery violated environmental requirements at least 141 times from 2008 to 2015, creating a risk for the safety of water in the Schuylkill River. The consent decree includes a $2.8 million penalty for the violations and an agreement that Yuengling will spend about $7 million to upgrade its operations to prevent further contamination.
