A bank cannot apply the work-product doctrine to a series of communications exchanged by a consultant it hired to operate an indebted construction company, the Pennsylvania Superior Court has ruled.

A unanimous three-judge panel issued a memorandum opinion July 1 in Giovinazzo v. Susquehanna Bank, affirming a trial court ruling that denied the bank’s claim that the document should be considered privileged.
