The Pennsylvania Supreme Court has agreed to take up an application for extraordinary relief filed by two of its former members regarding the wording of the impending ballot question on the mandatory judicial retirement age.

The high court said Wednesday it would establish an expedited briefing schedule to hear argument over a lawsuit brought by former Chief Justices Ronald D. Castille and Stephen Zappala Sr., along with attorney Richard A. Sprague, alleging that the present language of the ballot question is “deceitful” and “misleadingly designed.” The trio filed suit July 21 in the Commonwealth Court seeking injunctive and declaratory relief against Secretary of State Pedro A. Cortés over the “inexplicable about-face” he performed by adopting updated language for the question after a group of Republican senators challenged its earlier wording.
