Law enforcement cannot seize items that could be used for drug-related purposes if they could also serve a legitimate purpose, the Commonwealth Court has ruled, comparing glass pipes and scales to sandwich bags as items that can serve multiple functions.
A unanimous three-judge panel ruled July 28 in Commonwealth v. $603.45 Cash that 5,000 items taken from a York County tobacco shop were not subject to civil forfeiture because there was nothing directly linking them to drug use.
