Medical Malpractice • Misdiagnosis of Spinal Injuries • Premature Objections
McMillan v. Vava, PICS Case No. 16-0976 (C.P. Montgomery July 18, 2016) Smyth, J. (memorandum) (35 pages).
Two of the defendant groups raised preliminary objections and a third denied the allegations raised in a medical malpractice complaint alleging failure to diagnose and treat spinal injuries deriving from misreading of the radiology films and premature discharge from the hospital. The court explained why all of the preliminary objections were without merit and why more recent case law should have been included.
