One of the judges in my county has a tipstaff whose son was charged in a criminal case. The judge sent the following email.
“My understanding is that he (the son of the tipstaff) has already submitted an ARD application. My guess is that he will qualify for the program. I have handled several ARD cases where the defendant and I have a relationship that would normally warrant recusal. If he is approved by the district attorney for ARD, then I see no problem taking the case. I could even use it as a teaching tool. If he is not approved by the DA for ARD, however, then I will recuse.”
