Appeal from jury verdict in favor of defendant alleged that expert witness testimony was uncontroverted when defendant failed to call an expert witness. The court disagreed and found defendant’s cross-examination successfully questioned the credibility of plaintiff and his witness. Plaintiff’s history of not following up with physicians did not convince the jury that he would seek the recommended surgery. Plaintiff’s request for additur or a trial de novo was denied, the jury verdict upheld.
