A common pleas judge has urged the Pennsylvania Superior Court to uphold his decision to transfer a medical malpractice case from Philadelphia to Berks County, saying the plaintiff’s allegations regarding an echocardiogram allegedly improperly sent by a Philadelphia doctor was not enough to keep the case in the city.
Philadelphia Court of Common Pleas Judge Arnold New issued an opinion in Wentzel v. Cammarano outlining his reasoning for granting preliminary objections that sought to transfer the case from Philadelphia to Berks County. Since New’s decision to transfer was appealed, his opinion asked the Superior Court to affirm the ruling.
