The Montgomery County District Attorney’s Office has said the court should deny Bill Cosby’s attempt to strike from evidence a 2005 recorded phone call with his accuser’s mother, because the comedian was aware that he was being recorded.

The prosecution argued in a response filed late Sept. 1 that the Pennsylvania Wiretap Act only prohibits interception of oral communications believed to be private.
