A federal appeals court held that the School District of Philadelphia and a kindergarten teacher who let a student leave with a stranger—who later sexually assaulted the child—can be held liable for creating a danger to the student.

The U.S. Court of Appeals for the Third Circuit upheld a lower court’s holding that the district and deceased former teacher Reginald Littlejohn were not entitled to qualified immunity, given the harm suffered by “Jane,” the court’s name for the victim.
