Former Pennsylvania Attorney General Kathleen Kane’s allegedly false public statements about the racial motivations behind a corruption sting initiated by her predecessors are protected under absolute immunity, the Commonwealth Court has ruled.

In a memorandum opinion issued Monday morning, a three-judge panel ruled in favor of Kane and co-defendant Kevin Wevodau, a special agent in charge at the Office of Attorney General, denying former OAG agent Claude Thomas’ tort claims tied to Kane’s comments. The court also rejected Thomas’ bid for a name-clearing hearing.
