A divided en banc Commonwealth Court has ruled that state courts have jurisdiction over disputes arising under the Alternative Energy Portfolio Standards Act.

The court ruled 5-2 to affirm a trial judge’s decision not to cede jurisdiction to the state Public Utility Commission in Sunrise Energy v. FirstEnergy, finding that the legislature did not authorize the PUC or any other state agency to hear matters that require interpretation of the act.
