The Pennsylvania Supreme Court is set to review this week which version of the impairment rating guidelines should be used to determine workers’ compensation benefits, in a much-anticipated case during an argument session full of open questions with potentially significant answers.
In addition to Tuesday’s arguments in Protz v. Workers’ Compensation Appeal Board (Derry Area School District), the justices are set to take a closer look at whether an employee can receive workers’ compensation after suffering an injury while trying to help another worker in danger. The two-day argument session in Pittsburgh is also set to feature cases dealing with civil jury selection, underinsured motorist coverage and whether a court can effectively diagnose an individual’s mental illness.
