The Pennsylvania Superior Court has remanded a guardian ad litem fee dispute, telling the lower court that it cannot deny an attorney 79 percent of her requested payment by simply citing the number of hours the attorney billed.
In a published opinion filed Oct. 26, the court vacated an order from the Berks County Court of Common Pleas, which reimbursed attorney Jana R. Barnett for only $4,000 in legal fees after she requested more than $18,000 for her work on a custody case as guardian ad litem. The trial court had not disputed that Barnett spent 239 hours on the case, as her records showed, and said she did “exemplary” work, but said she spent too much time performing her services.
