A Lackawanna County judge has refused to seal settlement records in a medical malpractice case, saying defendants’ concerns about potential impact on future settlement talks and loss of business did not outweigh the need to preserve public access to court records.

Judge Terrence R. Nealon on Nov. 18 denied requests by Moses Taylor Hospital and one of its obstetricians to seal settlement records in Vaccaro v. Scranton Quincy Hospital. The settlement, which stems from claims that the defendant doctor failed to perform an emergency Cesarean section for more than an hour, included 40 percent in counsel fees and more than $350,000 for reimbursements of litigation costs.
