The Pennsylvania Supreme Court’s appellate rules committee has proposed a rule that would allow practitioners to cite nonprecedential decisions from the Superior Court.
The change would reverse the court’s existing ban and, according to the committee’s explanatory comment, is meant to create uniformity between different citation rules in the intermediate appellate courts.
