Bill of Particulars • Timeliness • Pa.R.C.P. 572(c) • Waiver • Mandatory Minimum Sentence
Commonwealth v. Libengood, PICS Case No. 16-1585 (Pa. Super. Dec. 16, 2016) Olson, J. (11 pages).
The trial court did not abuse its discretion in denying appellant’s motion in limine because appellant waived any objections to the bill of particulars furnished by the commonwealth by failing to file a timely motion pursuant to Pa.R.Cr.P. 572(c) and the trial court did not impose a mandatory minimum sentence pursuant to 42 Pa.C.S.A. §9718. Affirmed.
