A 20-year-old legal malpractice case against an Elk County law firm will not be reopened after a non pros ruling, the Pennsylvania Superior Court has ruled, noting that six years of inactivity and the death of several witnesses prejudiced the defendants.

In a published opinion filed Dec. 22, the Superior Court affirmed a trial court ruling against opening a non pros judgment in favor of Meyer, Wagner & Jacobs, which is now called Meyer Wagner Brown & Kraus, and name partner Thomas Wagner. A former client of the firm had initiated a legal malpractice action in 1996, which it sought to reopen.
