Erie Insurance can’t proceed with a legal malpractice suit against attorneys who settled a case for $2.25 million involving a man falsely accused of participating in the Sept. 11, 2001, terrorist attacks, the Pennsylvania Superior Court has ruled.

Although Erie contended that the attorneys who handled the case failed to properly preserve issues that would have led to a $2.45 million verdict being dismissed prior to reaching the $2.25 million settlement, a three-judge panel of the Superior Court ruled Dec. 28 that the arguments were meritless. The ruling upheld a decision from the Lawrence County Court of Common Pleas, and relied heavily on that decision.
