Presidential Election • Recount • Electronic Voting Machines • Timeliness • Standing

Stein v. Cortés, PICS Case No. 17-0013 (E.D. Pa. Dec. 12, 2016) Diamond, J. (31 pages).

Court denied plaintiffs’ request for injunctive relief and an immediate vote recount in a challenge to the 2016 presidential election because there was no credible evidence that voting machines had been hacked or that Pennsylvania’s voting system had been compromised, plaintiffs lacked standing, and plaintiffs’ delay in filing their claims risked making it impossible for Pennsylvania to certify its presidential electors by the day required by federal law. Injunction denied.
