An Office of Attorney General top agent’s lawsuit against Kathleen Kane and the OAG has been sent back to the Commonwealth Court, after a federal judge dismissed claims alleging Family and Medical Leave Act violations.

Kevin Wevodau’s FMLA claims against Kane were dismissed in an order Jan. 4 by U.S. District Judge Sylvia H. Rambo of the Middle District of Pennsylvania. But his claims under the Pennsylvania Whistleblower Law survive, and were remanded to the Commonwealth Court, where Wevodau’s suit was initially filed in April.
