While the bulk of a lawsuit in which three families allege an adoption agency lied about Polish orphans’ disabilities to couples looking to adopt them has been tossed, two Racketeering Influenced Corrupt Organization claims against its owner remain.
U.S. Magistrate Judge Robert C. Mitchell of the Western District of Pennsylvania dismissed seven of nine counts of the three couples’ 2010 complaint as having been filed too late. However, the two remaining RICO counts against Huminska Anioly Inc.’s principal, Mary Huminski, could move forward because they were timely under the longer statute of limitations for RICO claims.
