Even though the code of conduct for Pennsylvania judicial employees once referred to the state Whistleblower Law, the statute does not apply to the judiciary, the Commonwealth Court has ruled in declining to revive a case against the administrator of the Washington County Court of Common Pleas.

A unanimous three-judge panel of the court ruled Feb. 17 in Thomas v. Grimm to reaffirm a ruling from 2015 that said applying the state Whistleblower Law to judicial employees would violate the separation of powers doctrine. The ruling further determined that the state Supreme Court did not specifically adopt the Whistleblower Law when it referenced the statute in its code of conduct that was in effect at the time the alleged Whistleblower Law violation occurred.
