In the case of one law firm suing another over frivolous litigation, the Pennsylvania Superior Court has ruled that judicial immunity doesn’t shield litigants against Dragonetti Act claims.
The Superior Court’s ruling came in the matter of Freundlich & Littman v. Feierstein. The three-judge Superior Court panel vacated the lower court’s ruling sustaining the contention of defendants Bruce Chasan and the Law Offices of Bruce J. Chasanthat they are protected from wrongful use of civil proceedings and abuse of process claims by judicial immunity.
