Two college football players can move forward with a negligence case against their college tied to injuries they suffered during practice drills, the Pennsylvania Superior Court has ruled.
A unanimous two-judge panel held Feb. 24 in Feleccia v. Lackawanna College that a genuine issue of material fact exists regarding the college’s employment of unqualified medical personnel and the injured athletes’ assumption of risk. A jury should also determine whether the tackling drill that injured plaintiffs Augustus Feleccia and Justin T. Resch has enough relevance to the game of football to make an injury during the drill an inherent risk of the sport. The decision reversed the trial court’s grant of summary judgment to Lackawanna College and remanded the case for trial.
