In recent months, Pennsylvania courts have decided several important cases that reaffirm property ownership rights, further clarify how real estate transfer taxes are to be paid and confirm that a spouse who is not the property owner is not affected by a mechanics’ lien claim.
Property Ownership Rights
In Appeal of AMA/American Marketing Association, Inc., 142 A.3d 923 (2016), the Commonwealth Court determined an adjacent property owner’s claim that a proposed real estate development would negatively impact that property owner’s ability to cross the developed land cannot be considered by a municipality in reviewing the development application.
