Mirabella v. William Penn Charter Sch., PICS Case No. 17-0506 (E.D. Pa. March 20, 2017) Goldberg, J. (16 pages).
Plaintiffs sued defendant school alleging state law and ADA violations in school’s alleged discriminatory conduct related to student’s disability and student’s “constructive expulsion” but court found that plaintiffs lacked standing and that the claim was moot because student had no intention of returning to defendant school at the time the action was filed and had since graduated from another high school and was enrolled in college. Defendants’ summary judgment motion granted.
