Dragonetti Act • Pennsylvania Constitution Art. V, § 10(c) • Supervision of Attorney Conduct • Court’s Exclusive Prov-ince
Villani v. Siebert, PICS Case No. 17-0657 (Pa. April 26, 2017) Saylor, C. J., Baer, J. (concurring), Donohue (dissenting) (45 pages).
Trial court erred in granting appellee’s preliminary objections to a Dragonetti act complaint on constitutional grounds because appellee failed to establish that the Dragonetti act clearly and palpably violated the Pennsylvania constitution or that the court should per se immunize attorneys, as attorneys, from the application of the substantive tort principles promulgated by the political branch in the Dragonetti act. Reversed.
