A class action alleging that truck drivers in California have been deprived of their meal-and-rest periods is pre-empted by a federal law regulating the transportation industry, a federal judge ruled on Feb. 8.

U.S. District Court Judge Jacqueline Nguyen of the Central District of California was the second federal judge to invoke a new standard provided by the 9th U.S. Circuit Court of Appeals for deciding whether state laws are pre-empted by the Federal Aviation Administration Authorization Act, or FAAAA, which regulates the transportation and trucking industries.
