In the past few months, the Pennsylvania appellate courts have issued several opinions that have answered some of the most pressing questions in real estate law that have to do with oil and gas leases and property tax assessments. The following is a summary of a few recent cases and the impact they will have on the practice of Pennsylvania real estate attorneys.
Is Marcellus Shale Gas a Mineral?
In Butler v. Charles Powers Estate, 2013 Pa. LEXIS 789 (2013), the Pennsylvania Supreme Court decided whether title to Marcellus Shale gas vests in the owner of the “mineral” estate or the owner of the “oil and gas” estate.
