The decision affirmed an award of $275,000 in punitive damages to plaintiff Daniel Bonenberger by an Allegheny County Court of Common Pleas judge. The appeals court also approved the trial court’s grant of $89,160 in attorney’s fees to Bonenberger.

President Judge Joseph A. Del Sole, who wrote the opinion in Bonenberger v. Nationwide Mutual Insurance Co., was joined by Judge Patrick R. Tamilia. Judge Maureen Lally-Green concurred in the result only.
