An insurance company incorrectly denied underinsured motorist benefits to a passenger injured in a U-Haul truck even though the policy only provided UIM coverage to her while she was in a “car,” the Superior Court has ruled.

The intermediate appeals court said that the Prudential Property and Casualty Insurance Co. policy violated public policy because it contradicted the Motor Vehicle Financial Responsibility Law.
