With only Chief Justice Stephen A. Zappala dissenting, the high court in Erfer v. Schweiker rejected arguments that the plan, which drew 19 districts in the state, was deliberately engineered to create a partisan advantage for the Republican Party, which controls both houses of the state Legislature and is the party of the governor. The redistricting plan whittled Pennsylvania’s congressional seats from 21 to 19.
Joann Erfer and Jeffrey B. Albert, as Democratic voters, presented evidence that the GOP is likely to win a number of seats in the next congressional delegation elected from Pennsylvania that is disproportionate to the number of votes Republicans are expected to poll statewide.
