When an insurance company pays a landlord for fire damage, can it then recover for that loss against a negligent tenant?

The answer to that question is easier if a lease contains a waiver of subrogation clause. That is, the landlord waives any rights it (or its insurance company) may have to sue the tenant to the extent that the landlord has insurance coverage for the loss. Then, in most states the insurance company can’t recover.
