The Pennsylvania insurance commissioner’s civil RICO suit over the collapse of the PIC Insurance Group just got a little smaller now that a federal judge has dismissed all claims against one former director due to the broad language of a release he was granted when he and PIC settled a dispute.
The ruling is a victory for attorney Daniel T. Brier of Myers Brier & Kelly in Scranton, who argued that Insurance Commissioner M. Diane Koken is legally acting as the successor of PIC and must, therefore, honor the release PIC signed with former director Mark S. Cocco Jr.
