Over the past few years, Congress has been trying to compensate for the consequences caused to foreign nationals by Immigration and Naturalization Service processing delays.

In a series of legislative acts, starting with the “American Competitiveness in the Twenty-First Century Act,” Congress has provided for more flexibility in the law by permitting foreign nationals the benefits for which they would be otherwise eligible if INS had acted in a timely fashion.
